Payment Rule Waivers

Fraud and Abuse Waivers

The following are arrangements for which protection is sought under the Final ACO Waiver Rule jointly issued by the Centers for Medicare and Medicaid Services (“CMS”) and the Office of Inspector General (“OIG”) of the U.S. Department of Health and Human Services as described at 80 Fed. Reg. 66726 (Oct. 29, 2015) (Medicare Program: Final Waivers in Connection with the Shared Savings Program).

 

Orthopedic Surgery Clinical Engineering Joint Venture Arrangement

  • Parties to the arrangement
    • Caravan Health ACO 20 LLC d/b/a Stratum Med ACO (“Stratum ACO”)
    • Proctor Hospital (“Proctor Hospital”)
    • Midwest Orthopaedic Center, S.C. (“MOC”), an orthopedic group and its orthopedic surgeons (“MOC Physicians”)
    • Midwest Orthopaedic Surgeons II, LLC (“MOS-II”), an affiliate of the MOC Physicians
    • MOUPH, LLC (“MOUPH”)
  • Date of arrangement – January 1, 2025.
  • Items, services, goods, or facility provided
    • MOUPH, working in coordination with MOC and the MOC Physicians (and the MOC Physicians’ affiliate, MOS-II), provides comprehensive clinical direction and various administrative services (the “Services”) in connection the operation of Proctor Hospital’s outpatient orthopedic surgery service line (the “Outpatient Ortho Service Line”) and related ACO initiatives designated to achieve goals of the MSSP.
    • MOC and the MOC Physicians provide Services to Proctor Hospital on behalf of MOUPH.
    • Proctor Hospital provides MOUPH the support services.
    • Stratum ACO collaborates with Proctor Hospital and MOUPH in connection with the ongoing development, implementation, monitoring and enhancement of various programs, initiatives and measurement mechanisms to enhance the quality, efficiency and cost-effectiveness of the Outpatient Ortho Service Line to assist Proctor Hospital and MOUPH in (1) promoting accountability for the quality, patient safety, cost, and overall care of patients, (2) managing and coordinate care of patients, and (3) encouraging investment in infrastructure and redesigned care processes for high quality and efficient service delivery for patients.
